1. Acceptance of Terms

Welcome to FamWise, a platform operated by CreatureWeb ("Company," "we," "us," or "our"). By registering for an account, purchasing a subscription, accessing our media library, or participating in community discussions, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use to our services.

2. Description of Services & Memberships

FamWise provides an educational media platform and streaming library featuring content, articles, and interactive community functionality. We offer three primary account tiers:

• Free Forever Accounts: Standard access provided free of charge. This includes ad-supported media library access, partial WIRE Access, and Full Support Access.
• Individual Subscribers: Paid premium tier billed automatically on a monthly or annual basis. This includes ad-free video streaming, full premium content access (including WIRE and The Line), and family profile capabilities.
• Organizations: Billed annually based on volume licensing (minimum of 5 seats). Access is distributed by the Organization Administrator via unique Access Keys. If you leave or are removed from an Organization, your account will automatically revert to a Free account unless you upgrade individually.

3. Payments, Auto-Renewal, and Cancellations

All subscription payments are processed securely via our third-party payment provider, Stripe. By providing payment information, you authorize us to charge your designated payment method for all charges incurred.

• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless canceled prior to the renewal date.
• Cancellations: You may cancel your subscription at any time through your account dashboard. Upon cancellation, you will retain premium access until the end of your current paid billing period.
• Refunds: Except as required by law, all payments are non-refundable. We do not provide prorated refunds for partial-month memberships or unused time.

4. User-Generated Content and Community Conduct

FamWise allows users to interact with content via our comment system. You are solely responsible for any information, text, or materials you post ("User Content").

When participating in our community, you agree not to:

• Post content that is abusive, harassing, defamatory, vulgar, or obscene.
• Share personally identifiable information (PII) of others.
• Violate the intellectual property rights of third parties.
• Spam, solicit, or commercially advertise within comment threads.

We reserve the right to review, moderate, edit, or remove User Content at our sole discretion, without notice, if we determine it violates these Terms or our community guidelines.

5. Child Safety and Privacy

The safety and privacy of minors on FamWise is a core priority. User behavior, data collection regarding minors, and platform moderation are strictly governed by our Child Safety Policy. Please review this policy. Violations of child safety protocols will result in immediate account termination and, if applicable, reporting to law enforcement.

6. Intellectual Property & DMCA

All proprietary content on FamWise—including videos, articles, interface design, graphics, and logos—is the intellectual property of CreatureWeb or its licensors. You may not download (beyond temporary streaming buffers), redistribute, pirate, or alter our content.

If you believe that any User Content or platform material infringes upon your copyright, please contact our support team with a formal Digital Millennium Copyright Act (DMCA) notice including your contact information, the infringing URL, and a statement of your good faith belief regarding the infringement.

7. Account Suspension and Termination

We reserve the right to suspend or terminate your account—without refund—if you breach any of these Terms, engage in systemic abuse of our streaming infrastructure, circumvent access controls, or violate the Child Safety Policy. Organization Administrators acknowledge that violations by an individual seat holder may result in the revocation of that specific Access Key.

8. "As Is" Disclaimer and Limitation of Liability

The FamWise service, including video streaming, is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted, completely secure, or error-free.

To the maximum extent permitted by law, CreatureWeb shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date on this page, or, for major changes, via email or platform notification. Your continued use of FamWise following any modification constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CreatureWeb operates, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts corresponding to our operational jurisdiction.
